KUALA LUMPUR: Two directors of Credit Tip Off Service (CTOS) have succeeded in their attempt to have a court cancel their arrest warrants.
This followed an apology by their lawyer to the judge over their directors’ failure to turn up in court to face their summons charges under the Companies Act 1965.
Defence counsel David Matthews told Sessions Court judge Akhtar Tahir that it was entirely his (the lawyer’s) fault.
“I got a wrong date. We thought we were supposed to be in court a week later,” he told Akhtar on Wednesday.
Akhtar then cancelled the arrest warrants for the two directors.
Brothers Chung Tze Keong, 52, and Tze Wen, 49, were charged in the Sessions Court here with two offences under Section 169 (1) of the Act.
On the first charge, the two, as CTOS Data System Sdn Bhd directors, are accused of failing to table a profit-and-loss account for the company for the financial year 2005 at an annual general meeting (AGM) that should have been held within 15 months of from the previous meeting.
On the second charge, the brothers, as CTOS EMR Sdn Bhd directors, are alleged to have failed to table similar accounts for 2005 at least six months before the next AGM.
The court issued arrest warrants on the two after they failed to turn up in court on July 12 for their cases.
Another defence lawyer, Ashok Kandiah, said his clients had no objections to for a joint trial.
Prosecuting officer A. Narainasami, from the Companies Commission of Malaysia, confirmed to the judge that the trial would involved same witnesses.
The judge set three days from Oct 8 for a joint trial.
On July 6, the two brothers and two company secretaries pleaded not guilty in two courts to a total of 85 charges under the Act.
The secretaries are lawyer-cum-secretary Chiam Tow Loon, 52, and secretary Loeonie Lee Shuet Fong, 42.
The charges mainly involve the failure to submit annual return reports for four companies – CTOS Sdn Bhd, CTOS Data System Sdn Bhd, CTOS Business System Sdn Bhd and CTOS EMR Sdn Bhd – which are database providers.
The brothers face 17 charges each while Chiam and Lee are faced with 15 charges each, involving three of the companies.
The rest of the charges are levelled against the four companies.
